This Privacy Policy (“Policy”) describes how Fixomotive Solutions Private Limited (CIN: U62013MP2025PTC074186), having its registered office at Shop No. C1, Kalptarru Mall, Mahaveer Chowk, Balaghat – 481001, Madhya Pradesh, India (“Fixomotive”, “we”, “our”, “us”), collects, uses, shares, stores, and protects your personal information when you access or use our software, website, mobile application, or related services (collectively, the “Platform”).

This Policy applies to both Fixomotive products — Fixomotive Repair and Fixomotive Skills — and all subscription plans, whether accessed directly through Fixomotive or through an authorized Channel Partner.

Fixomotive is committed to protecting your privacy and handling your personal data in compliance with the Digital Personal Data Protection Act, 2023 (“DPDPA”), the Information Technology Act, 2000, and other applicable Indian data protection laws.

By accessing or using the Platform, you consent to the collection, use, and sharing of your information as described in this Policy. If you do not agree with this Policy, please do not use the Platform.

  1. Our Role as Data Fiduciary

Under the Digital Personal Data Protection Act, 2023, Fixomotive acts as the Data Fiduciary for the personal data you share with us. This means we determine the purpose and means of processing your personal data, and we are responsible for protecting your data in accordance with applicable law.

For subscriptions obtained through authorized Channel Partners, Fixomotive and the Channel Partner may act as joint Data Fiduciaries. Details of this arrangement are provided in Section 7.

This Privacy Policy applies equally to users accessing Fixomotive’s paid subscriptions and Forever-Free Features. All users, regardless of payment status, are entitled to the same data protection standards under the Digital Personal Data Protection Act, 2023.

  1. Information We Collect

We collect the following categories of information when you register, use, or interact with the Platform:

2.1 Personal Information You Provide

  • Full name
  • Mobile number
  • Email address
  • Workshop or business name
  • Workshop or business address
  • Region, state, and country
  • GSTIN or business registration details (if applicable)
  • Profile information and preferences you choose to share

2.2 Account and Subscription Information

  • Login credentials OTP-based update )
  • Subscription plan, billing cycle, and payment status
  • Invoice and transaction history
  • Payment method details (managed through secure payment gateways — we do not store complete card or UPI credentials)

2.3 Device and Technical Information

  • Device type, model, and operating system
  • Browser type and version
  • IP address and approximate geographic location
  • Language and time zone preferences
  • Unique device identifiers where applicable

2.4 Usage and Behavioural Data

  • Screens and pages visited within the Platform
  • Features used and frequency of use
  • Time spent on specific screens or tasks
  • Search queries within the Platform
  • Click patterns and navigation flows
  • Error logs and performance metrics
  • Fixi AI chat interactions and queries

2.5 Communication Records

  • Support tickets, chat conversations, and email interactions
  • Feedback, survey responses, and ratings
  • Call recordings or transcripts (if applicable)

2.6 Cookies and Tracking Data

We use cookies and similar tracking technologies. See Section 13 for detailed information on cookies.

We do not collect unnecessary personal data beyond what is required to operate the Platform and fulfill the purposes outlined in this Policy.

  1. Why We Collect This Information

We collect and process your information for the following legitimate purposes:

3.1 Service Delivery

  • Creating and managing your account
  • Providing access to Fixomotive Repair and Fixomotive Skills
  • Verifying authentic workshop or professional use
  • Processing subscriptions, billing, and invoicing
  • Delivering customer support and resolving issues

3.2 Communication

  • Sending account-related notifications, updates, and alerts
  • Delivering transactional messages (OTP, payment confirmations, invoices)
  • Responding to your queries and support requests
  • Informing you about changes to the Platform or policies

3.3 Marketing Communication (with Consent)

  • Sending promotional offers, new feature announcements, and newsletters
  • Informing you about new products, services, or events
  • Providing personalized recommendations

Marketing communications are sent only with your opt-in consent. You may unsubscribe at any time by clicking the unsubscribe link in the email or by emailing contact@fixomotive.in.

3.4 Analytics and Product Improvement

  • Understanding how technicians use the Platform
  • Identifying most and least used features
  • Region-wise and segment-wise usage patterns
  • Improving software performance, stability, and accuracy
  • Planning future development and product roadmap

3.5 Fixi AI Training and Improvement

We use anonymized user interactions with our Fixi AI assistant to train, refine, and improve the AI models. Specifically:

  • User queries and AI responses are anonymized and stripped of personally identifiable information
  • Anonymized conversations are used to improve AI accuracy, response quality, and understanding of automotive terminology
  • No personal identifiers (name, mobile, email, workshop name) are retained in AI training data
  • You may request exclusion of your interactions from AI training by emailing contact@fixomotive.in

3.6 Security and Fraud Prevention

  • Detecting and preventing unauthorized access
  • Identifying and blocking fraudulent activity
  • Maintaining platform security and integrity
  • Investigating violations of our Terms and Conditions

3.7 Legal and Regulatory Compliance

  • Complying with applicable Indian laws and regulations
  • Responding to legal requests from authorized government authorities
  • Maintaining tax, billing, and financial records as required by law
  • Protecting our legal rights and interests
  1. Legal Basis for Processing

Under the Digital Personal Data Protection Act, 2023, we process your personal data on the following legal grounds:

  • Your explicit consent, obtained at the time of registration and use
  • Necessity for performance of the contract (your subscription agreement)
  • Legitimate business interests (improving the Platform, fraud prevention)
  • Compliance with legal obligations
  • Protection of vital interests where applicable

You may withdraw your consent at any time by emailing contact@fixomotive.in, subject to legal and contractual obligations that may require continued processing.

  1. How We Share Your Information

Fixomotive follows a strict no-selling of personal data policy. We do not sell, rent, or trade your personal data to any third party for marketing or commercial purposes.

Your personal information may be shared only in the following limited circumstances:

5.1 With You

We provide you with access to your own data through your account dashboard or upon request.

5.2 With Authorized Service Providers

We share data with third-party service providers who assist us in operating the Platform, under strict confidentiality and data protection obligations. These include:

  • Cloud hosting providers (for data storage and infrastructure)
  • Payment gateways and processors (Razorpay and others)
  • SMS and email service providers (for OTP, notifications, and communication)
  • Customer Relationship Management (CRM) platforms
  • Analytics and performance monitoring tools
  • Customer support and helpdesk platforms
  • Fraud detection and cybersecurity service providers

These service providers are contractually bound to process your data only for the purposes specified by Fixomotive and to implement appropriate security measures.

5.3 With Channel Partners

If you subscribed to the Platform through an authorized Channel Partner, your personal data will be shared between Fixomotive and the Channel Partner on a joint basis. Further details are provided in Section 7 of this Policy.

5.4 With Government Authorities

We may disclose your information to government authorities, law enforcement agencies, regulators, or courts when:

  • Required by a valid court order, summons, or legal notice
  • Compelled by applicable law, regulation, or statutory requirement
  • Necessary to protect the rights, property, or safety of Fixomotive, our users, or the public
  • Required for investigating fraud, security threats, or illegal activity

We share only the minimum information necessary and, where legally permitted, notify the affected user.

5.5 In Business Transfers

In the event of a merger, acquisition, restructuring, sale of assets, or bankruptcy, your personal data may be transferred as part of the business transaction. We will notify you of any such transfer and ensure that the acquiring party is bound by terms consistent with this Policy.

  1. Fixomotive Skills — Content Partner Data Handling

The Fixomotive Skills product may feature educational content provided by third-party sponsors, supporters, OEMs, training institutes, and other content contributors (“Content Partners”). When you interact with Content Partner material on the Platform:

  • We may share limited aggregate and anonymized engagement data (such as number of views, completion rates, and region-wise usage) with the respective Content Partner for their reporting and content improvement purposes
  • We do not share your personal identifying information (name, mobile, email, workshop details) with Content Partners unless you explicitly opt in for sponsored programs, certifications, or contests
  • If you opt in to any Content Partner program, the Content Partner may collect your data directly under their own privacy policy — we recommend reviewing the Content Partner’s privacy practices before opting in
  • Fixomotive is not responsible for the data handling practices of Content Partners in programs you opt into voluntarily
  1. Channel Partner Data Sharing

Fixomotive offers its Platform through authorized Channel Partners, resellers, and white-label distributors. This section explains how your data is handled when your subscription is obtained through a Channel Partner.

7.1 Joint Data Custodianship

When you subscribe through a Channel Partner:

  • Your personal data, account information, and usage data are shared between Fixomotive and the Channel Partner
  • Both Fixomotive and the Channel Partner act as joint Data Fiduciaries under the Digital Personal Data Protection Act, 2023
  • Each party is independently responsible for protecting your data under applicable laws
  • Both parties have access to your relevant data for service delivery purposes

7.2 What Channel Partners May Access

Channel Partners may have access to the following information about users they onboard:

  • Your personal details (name, mobile, email, workshop information)
  • Your subscription plan, billing details, and payment history
  • Your support tickets and communication records
  • Your usage statistics and engagement data
  • Other information necessary for their service delivery

7.3 Purposes of Channel Partner Access

Channel Partners use this data for:

  • Processing your payments and issuing invoices
  • Delivering customer support and technical assistance
  • Handling refund and cancellation requests
  • Managing your account and subscription lifecycle
  • Communicating about service updates or relevant offers
  • Complying with their own legal and tax obligations

7.4 Channel Partner Privacy Practices

Each Channel Partner has its own privacy policy that governs how they collect, use, store, and share your data. When you subscribe through a Channel Partner:

  • You should review the Channel Partner’s privacy policy directly
  • The Channel Partner’s privacy policy applies in addition to this Policy
  • In case of conflict, the Channel Partner’s privacy policy prevails for matters under their direct control (payment data, customer support communications, their own marketing)
  • Fixomotive is not responsible for the Channel Partner’s data handling practices

7.5 Your Rights with Channel Partners

If you wish to exercise data rights (access, correction, deletion) regarding data held by a Channel Partner, you should:

  1. Contact the Channel Partner directly through their published contact details
  2. Follow the Channel Partner’s process for data rights requests
  3. Alternatively, you may email contact@fixomotive.in and we will assist in facilitating your request with the Channel Partner

For data that Fixomotive holds independently (separate from Channel Partner records), you may contact us directly.

  1. Third-Party Services and Integrations

The Platform integrates with the following categories of third-party services:

  • Payment gateways (Razorpay and similar providers)
  • CRM and customer support platforms
  • Communication APIs (SMS and email service providers)
  • Cloud hosting and infrastructure providers
  • Analytics, performance monitoring, and error tracking tools
  • AI and machine learning service providers (for Fixi AI features)

Each of these services operates under its own privacy policy and terms of service. While we select service providers with strong data protection practices, Fixomotive is not responsible for the independent data practices of these third parties. We encourage you to review the privacy policies of key service providers directly if you have concerns.

  1. Data Storage and Security

9.1 Data Localization

All personal data of our users is stored on servers located in India, in compliance with data localization requirements under applicable Indian law.

9.2 Security Measures

We implement reasonable and appropriate technical and organizational security measures to protect your personal data, including:

  • Encrypted database storage and transmission
  • Secure communication channels (HTTPS/TLS)
  • Role-based access control for internal systems
  • Limited employee access on a need-to-know basis
  • Regular security audits and vulnerability assessments
  • OTP security update
  • Firewall and intrusion detection systems
  • Data backup and disaster recovery procedures

9.3 Limitation of Security

Despite our best efforts, no electronic transmission or storage system is 100% secure. While we aim for industry-standard best practices, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your login credentials and for notifying us immediately of any suspected unauthorized access.

9.4 Data Breach Notification

In the event of a personal data breach that is likely to result in significant harm to you:

  • We will notify affected users through email or in-app notification as soon as practicable
  • We will report the breach to the Data Protection Board of India as required by the Digital Personal Data Protection Act, 2023
  • We will take prompt action to contain the breach, investigate its cause, and prevent recurrence
  • We will provide affected users with information on protective measures they can take
  1. Data Retention

We retain your data only for as long as necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements.

10.1 Account Data

  • Your personal account data (name, mobile, email, workshop details) is retained as long as your account remains active
  • Upon account closure or deletion request, eligible personal data is permanently deleted within 30 days
  • Certain data may be retained longer where required by law (for example, billing records for tax compliance)

10.2 Usage and Analytics Data

  • Aggregated and anonymized usage data may be retained indefinitely for product improvement and analytics
  • This data cannot be used to personally identify you

10.3 Communication Records

  • Support tickets, chat logs, and email interactions may be retained for improving support quality, training purposes, dispute resolution, and service accuracy
  • Such records may be retained in non-identifiable form even after your account is closed

10.4 Billing and Financial Records

  • Billing, invoice, and transaction records are retained for 7 years or as required under Indian taxation and financial regulations (Income Tax Act, GST Act, Companies Act)
  • These records cannot be deleted immediately upon request due to compliance obligations

10.5 Backups

  • Deleted data may continue to exist temporarily in encrypted system backups for security and disaster recovery purposes
  • Backup data is overwritten according to standard backup retention cycles (typically 30 to 90 days)

10.6 AI Training Data

  • Anonymized conversations used for Fixi AI training may be retained for ongoing model improvement
  • This data is stripped of personal identifiers before being used for training
  1. Your Rights as a Data Principal

Under the Digital Personal Data Protection Act, 2023, you are a “Data Principal” with the following rights:

11.1 Right to Access

You may request information about the personal data we hold about you, including what data is collected, how it is used, and with whom it is shared.

11.2 Right to Correction

You may request correction, completion, or updating of inaccurate, incomplete, or outdated personal data.

11.3 Right to Erasure (Deletion)

You may request deletion of your personal data where:

  • The data is no longer necessary for the purposes it was collected
  • You withdraw consent on which the processing is based
  • The data was unlawfully processed
  • Deletion is required for compliance with a legal obligation

Note: Some data may be retained where legally required (billing, tax records) or necessary for legitimate purposes (dispute resolution, fraud prevention).

11.4 Right to Withdraw Consent

You may withdraw your consent to data processing at any time. Withdrawal of consent may affect our ability to provide certain services to you.

11.5 Right to Grievance Redressal

You have the right to register complaints about the handling of your data. You may approach our Data Protection Officer (see Section 16) or escalate to the Data Protection Board of India.

11.6 Right to Nominate

You may nominate another individual to exercise your rights in the event of your death or incapacity.

11.7 How to Exercise Your Rights

To exercise any of the above rights, send an email to contact@fixomotive.in with the subject line “Data Rights Request”, along with your registered account details and a clear description of your request. We will respond to your request within a reasonable time, typically within 30 days.

We may require identity verification before processing certain requests to protect your data from unauthorized access.

  1. Marketing Communication Preferences

We send two types of communications to users:

12.1 Transactional Communication

These include OTPs, payment confirmations, invoices, service notifications, security alerts, and policy updates. Transactional communication cannot be opted out of, as it is necessary for service delivery.

12.2 Marketing Communication

These include promotional offers, product announcements, newsletters, and personalized recommendations. Marketing communication is sent only with your explicit opt-in consent. You may opt out at any time by:

  • Clicking the “unsubscribe” link in any marketing email
  • Replying “STOP” to marketing SMS messages
  • Updating your communication preferences in your account settings
  • Emailing contact@fixomotive.in with your unsubscribe request

Opting out of marketing communication will not affect your access to the Platform or transactional messages.

  1. Cookies and Tracking Technologies

We use cookies, web beacons, and similar tracking technologies to enhance your experience on the Platform.

13.1 Types of Cookies We Use

  • Essential cookies — required for core Platform functionality (login, session management, security)
  • Analytics cookies — help us understand how users interact with the Platform (via tools such as Google Analytics)
  • Preference cookies — remember your settings and preferences
  • Performance cookies — monitor Platform performance and identify issues

13.2 Third-Party Cookies

Third-party analytics and performance tools (including Google Analytics) may set their own cookies. These services operate under their respective privacy policies.

13.3 Managing Cookies

You can control cookies through your browser settings. Most browsers allow you to:

  • View and delete cookies
  • Block cookies from specific websites
  • Block third-party cookies
  • Clear all cookies when the browser is closed

Please note that blocking essential cookies may impact the functionality of the Platform, including login and session management.

  1. Children’s Privacy

Fixomotive is strictly intended for professional use by automotive workshops, mechanics, technicians, training institutes, and related businesses. The Platform is not designed for or directed at children under the age of 18.

  • We do not knowingly collect personal data from individuals under 18 years of age
  • If we become aware that we have collected personal data from a minor, we will take prompt steps to delete such data
  • Parents or guardians who believe their child has provided us with personal information should contact us immediately at contact@fixomotive.in
  1. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, legal requirements, or regulatory guidance. When we make changes:

  • The updated Policy will be published on our website with a revised “Last Updated” date
  • For material changes, we will notify registered users via email or prominent in-app notification
  • Continued use of the Platform after changes constitutes your acceptance of the updated Policy
  • If you do not agree with the updated Policy, you must stop using the Platform and may request account closure

We encourage you to review this Policy periodically to stay informed about how we protect your data.

  1. Grievance Redressal and Data Protection Officer

In accordance with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000, Fixomotive has designated a Data Protection Officer to address user concerns, grievances, and data rights requests.

  1. Governing Law and Jurisdiction

This Privacy Policy is governed by and construed in accordance with the laws of India, including the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, and other applicable regulations.

Any dispute arising out of or in connection with this Policy shall be resolved in accordance with the dispute resolution mechanism set out in the Fixomotive Terms and Conditions. Courts at Balaghat, Madhya Pradesh shall have exclusive jurisdiction over any non-arbitrable matters.
