1. Introduction
This End-User License Agreement (“Agreement” or “EULA”) is a legal agreement between You (an individual or entity) and Fixomotive Solutions Private Limited (CIN: U62013MP2025PTC074186), having its registered office at Shop No. C1, Kalptarru Mall, Mahaveer Chowk, Balaghat – 481001, Madhya Pradesh, India (“Fixomotive”, “We”, “Us”, or “Our”), regarding your use of Fixomotive software, websites, mobile applications, AI tools, APIs, and related services across its products — Fixomotive Repair, Fixomotive Skills, and Fixomotive Store (collectively, the “Software”).
By creating an account, accessing, downloading, installing, or using the Software, you agree to be bound by this EULA. If you do not agree, do not use the Software. This EULA is supplemented by, and should be read together with, our Terms and Conditions, Privacy Policy, Refund and Cancellation Policy, AI Output Policy, and (for Fixomotive Store) our Acceptable Use Policy and Domain Registration Agreement. In case of conflict, the Terms and Conditions prevail.
2. License Grant
Fixomotive grants you a limited, non-exclusive, non-transferable, non-sub-licensable, revocable license to access and use the Software strictly in accordance with this EULA. This license is granted for:
- Your professional and business use only (automotive workshops, technicians, training institutes, and automotive businesses using Fixomotive Store)
- A single account per authorized user
- The duration of your subscription, free trial, or free plan
For Fixomotive Store, this license includes the right to use the Software to build, configure, and publish your own website, store, and booking pages, and to operate your own lawful business through them. You agree not to copy, modify, distribute, sell, lease, or sub-license any part of the Software itself (as distinct from the content you create).
3. Professional and Business Use
Fixomotive Repair and Fixomotive Skills are designed for professional automotive technicians, workshops, garages, and engineers, and are not intended for DIY, consumer, or non-technical users. Fixomotive Store is intended for automotive businesses operating lawfully in India. You acknowledge that the diagrams, pinouts, DTC data, and suggestions are provided for guidance only, that final diagnostic and repair decisions are the responsibility of the technician or workshop, and that misuse or misinterpretation of data is not Fixomotive’s liability.
4. Free Trial and Free Plan
Fixomotive offers a free trial of 3 to 30 days for Fixomotive Repair and Fixomotive Skills (depending on promotional offers), and a free plan for Fixomotive Store. During a free trial no credit card, auto-debit, or UPI mandate is required, and access stops when the trial expires unless you upgrade to a paid plan. The Fixomotive Store free plan provides limited features and may be modified or discontinued at any time, as described in the Terms and Conditions.
5. Subscription, Refund and Cancellation
Paid subscriptions, plans, add-ons, and domains are governed by our Refund and Cancellation Policy and the Terms and Conditions, which set out the applicable billing cycles, renewal terms, refund exceptions, and cancellation procedures. To the extent of any inconsistency, the Refund and Cancellation Policy and Terms and Conditions prevail over this Section. Domains are non-refundable, and add-ons are non-refundable once activated, as set out in the Refund and Cancellation Policy.
6. Account Responsibilities
You agree to provide accurate registration information, maintain the confidentiality of your login credentials, prevent unauthorized access to your account, and notify Fixomotive immediately of any unauthorized use. Fixomotive reserves the right to suspend or terminate accounts for misuse or violation of policies.
7. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or extract data from the Software
- Copy diagrams, pinouts, AI outputs, templates, or other copyright-protected content
- Share login credentials or use the Software to build a competing product
- Use AI models or any feature for illegal, harmful, or unethical activities
- Upload harmful code or viruses, or attempt unauthorized access
- Publish, host, or transmit through Fixomotive Store any unlawful, fraudulent, infringing, or prohibited content (as detailed in the Acceptable Use Policy)
Where a Fixomotive Store website or domain is used for any illegal activity or in breach of the Acceptable Use Policy, Fixomotive may immediately suspend the website and/or domain without liability.
8. Your Content and Ownership (Fixomotive Store)
You retain ownership of the content you upload to or create on Fixomotive Store (text, images, logos, listings, prices, and similar — “User Content”). By publishing User Content, you grant Fixomotive a non-exclusive, royalty-free license to host, store, and display it solely to operate and provide the Software and your published website. You represent that you own or have all rights to your User Content and that it does not infringe any third-party rights or violate any law.
9. AI-Generated Content Disclaimer
The Software includes AI-powered features such as the Fixi AI troubleshooting assistant, smart DTC search, interactive diagnostic suggestions, and multilingual automotive support. AI responses are generated predictions and may be incomplete or inaccurate. All information must be cross-verified by a trained technician. Fixomotive is not liable for any damage resulting from AI-generated guidance. AI features are also subject to our AI Output Policy.
10. Data Usage and Privacy
Your data is handled in accordance with our Privacy Policy. Fixomotive collects limited technical and usage data to improve accuracy, enhance the user experience, and support customer assistance, and may use anonymized and aggregated data for product improvement. We do not sell user data. For Fixomotive Store, the personal data of your website’s End Visitors is controlled by you (the Site Owner), with Fixomotive acting only as a data processor, as explained in the Privacy Policy. You may request deletion of your data at any time.
11. Intellectual Property Rights
All Software content — including diagrams, component details, ECU pinouts, processed and structured manuals, AI models and prompts, website templates and design assets, UI/UX designs, tools, features, and APIs — is the exclusive intellectual property of Fixomotive Solutions Private Limited or its licensors. Unauthorized copying or redistribution is strictly prohibited. Your own User Content remains yours, as set out in Section 8.
12. Service Availability
Fixomotive strives for high availability, including for Fixomotive Store website hosting, but availability may vary due to maintenance, server issues, internet connectivity, third-party providers, or domain/DNS issues outside our control. We are not liable for downtime beyond our reasonable control. Refund eligibility for prolonged outages is governed by the Refund and Cancellation Policy.
13. Third-Party Integrations
The Software may integrate with third-party services such as Razorpay, domain registrars, Zoho products, SMS and email gateways, and AI APIs. Fixomotive is not responsible for third-party outages, failures, or their independent terms and practices.
14. Domains (Fixomotive Store)
Domains purchased through Fixomotive Store are registered through our authorized registration partner and are subject to the registrar, registry, and ICANN rules, as well as our Terms and Conditions and Domain Registration Agreement. Domains are non-refundable, and .in and .bharat domains require KYC verification mandated by the .IN Registry (NIXI). If you map a domain you registered elsewhere, you remain responsible for that domain with your own registrar.
15. Limitation of Liability
Fixomotive is not liable for incorrect diagnosis or repair, vehicle damage, loss of business or revenue, data loss, network or internet issues, content published by a Site Owner, or transactions between a Site Owner and its End Visitors. Fixomotive’s maximum aggregate liability is limited to the amount you paid Fixomotive in the three months preceding the event giving rise to the claim, consistent with the Terms and Conditions.
16. Termination
Fixomotive may suspend or terminate your access if you violate this EULA or the Acceptable Use Policy, misuse or share proprietary data, attempt unauthorized system access, or publish prohibited content. Upon termination you must stop using the Software immediately; your Fixomotive Store website may be unpublished and stored content deleted, subject to the Terms and Conditions and Privacy Policy.
17. Updates and Modifications
Fixomotive may release updates, new versions, or modify features at any time. Continued use after updates indicates acceptance of the updated EULA.
18. Governing Law and Dispute Resolution
This Agreement is governed by the laws of India. Any dispute shall be resolved in accordance with the dispute-resolution mechanism set out in the Fixomotive Terms and Conditions — good-faith negotiation first, then arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by Fixomotive and a seat and venue at Balaghat, Madhya Pradesh. Courts at Balaghat, Madhya Pradesh shall have exclusive jurisdiction over any non-arbitrable matters.

20. Acceptance
By using Fixomotive, you acknowledge that you have read and understood this EULA, that you agree to its terms and conditions, and that you are authorized to use the Software for professional or business purposes.
