Terms & Conditions

These Terms and Conditions (“Terms”) form a legally binding agreement between you (“User”, “you”) and Fixomotive Solutions Private Limited (CIN: U62013MP2025PTC074186), having its registered office at Shop No. C1, Kalptarru Mall, Mahaveer Chowk, Balaghat – 481001, Madhya Pradesh, India (“Fixomotive”, “Company”, “we”, “our”, “us”).

Fixomotive operates three products under its Platform: Fixomotive Repair (a troubleshooting and reference platform), Fixomotive Skills (a learning and simulation platform), and Fixomotive Store (a website builder, online booking, marketing, and online-store platform for automotive businesses, available at Fixomotive Store.com). All three products are governed by these Terms unless specifically stated otherwise. Where a clause applies to only a particular product, it is clearly identified.

By accessing, registering, or using our software, websites, mobile applications, or services (collectively, the “Platform”), you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not access or use the Platform.

1. Service Description

Fixomotive is a Software-as-a-Service (SaaS) platform that provides the following products:

1.1 Fixomotive Repair

• Automotive troubleshooting guidance and reference data
• AI-based assistant support for diagnostic queries (Fixi AI)
• Diagnostic Trouble Code (DTC) reference and explanations
• Wiring diagrams, component details, and ECM/ECU pinouts
• Technical manuals and workshop information

1.2 Fixomotive Skills

• Interactive learning modules for automotive technicians
• AI-guided challenge tasks and exercises
• Vehicle simulations and fault-injection scenarios
• Skill assessments and progress tracking
• Educational content from Fixomotive and authorized partners

1.3 Fixomotive Store

• A no-code website builder and content management tool for automotive businesses (workshops, detailing studios, body shops, washing centres, and similar)
• Online booking and appointment scheduling tools
• Marketing and customer-engagement tools
• An online store / e-commerce tool for selling products and services
• Web hosting for websites published through Fixomotive Store
• Domain name registration through our authorized registration partner, and custom-domain mapping for domains you already own
• Free and paid subscription plans, together with optional paid add-ons

Fixomotive does not sell physical automotive hardware, diagnostic tools, or perform actual repairs. Fixomotive Repair and Fixomotive Skills provide reference and educational information only. Fixomotive Store provides website-building, hosting, and related tools only — Fixomotive is not a party to, and does not provide, the goods or services that you (the Site Owner) sell or offer through a website built on Fixomotive Store.

2. Definitions

In addition to terms defined elsewhere, the following apply specifically to Fixomotive Store:

• “Site Owner” (also “you” in Fixomotive Store clauses) means the User who creates, configures, and publishes a website, store, or booking page using Fixomotive Store.
• “Published Site” means any website, store, booking page, or other content that a Site Owner makes publicly available using Fixomotive Store.
• “End Visitor” means any person who visits, browses, books an appointment, makes an enquiry, or purchases goods or services through a Site Owner’s Published Site. End Visitors are the Site Owner’s own customers, not Fixomotive’s.
• “User Content” means any text, images, logos, product listings, prices, contact details, or other material that a Site Owner uploads to or displays through Fixomotive Store.

3. Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• For Fixomotive Repair and Fixomotive Skills: be a professional automotive workshop, qualified mechanic, automotive technician, garage owner, training institute, or authorized representative thereof
• For Fixomotive Store: be an automotive business, business owner, or an authorized representative operating a lawful business in India
• Have legal capacity to enter into binding contracts under Indian law
• Provide accurate, current, and complete information

Fixomotive Repair and Fixomotive Skills are NOT intended for DIY users, hobbyists, untrained individuals, persons under 18, or any unauthorized commercial activity. By using the Platform, you confirm that you meet all applicable eligibility requirements for the product(s) you use.

4. Account Registration

To access the Platform, you must:

• Create an account using a valid mobile number and/or email address
• Provide accurate business name and address
• Verify your identity through OTP or other verification methods
• Maintain the confidentiality of your login credentials
• Notify us immediately of any unauthorized access to your account

You are solely responsible for all activities performed using your account, for maintaining the security of your password, and for any losses arising from unauthorized account use. Sharing of login credentials with any other individual or business is strictly prohibited and may result in immediate account termination without refund.

5. License and Usage Rights

Subject to your compliance with these Terms and payment of applicable fees, Fixomotive grants you a limited, revocable, non-transferable, non-exclusive, non-sublicensable license to access and use the Platform for your business’s internal and operational use only.

You shall NOT:

• Copy, reproduce, scrape, or extract any content, diagrams, data, videos, templates, AI outputs, or other materials from the Platform (other than User Content you yourself uploaded)
• Share, transfer, or sublicense your account access to any third party
• Use the Platform to develop, train, or improve any competing product or service
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Platform
• Use automated tools, bots, or scrapers to access the Platform
• Resell, redistribute, or commercialize the Platform or its content, except as expressly permitted for a Site Owner’s lawful use of Fixomotive Store to operate its own Published Site
• Remove, modify, or obscure any proprietary notices or branding

Violation of any of the above shall result in immediate account termination without refund and may attract legal action including damages, injunctions, and criminal prosecution under applicable Indian laws.

6. Data Accuracy and Educational Purpose (Fixomotive Repair & Skills)

The information provided through Fixomotive Repair and Fixomotive Skills, including but not limited to wiring diagrams, DTC explanations, component data, repair guidance, and AI-generated content, is for educational and reference purposes only.

You acknowledge and agree that:

• Information may not always be 100% accurate, complete, or current
• Information is not OEM-verified unless explicitly stated
• Vehicle specifications and procedures may vary by model, year, and region
• You must independently verify all information using official manufacturer guidelines before performing any repair
• You must follow proper diagnostic procedures, safety protocols, and use professional tools

Fixomotive shall not be liable for any damages, losses, injuries, or claims arising from your reliance on, interpretation of, or use of this content.

7. Free Trial Terms (Fixomotive Repair & Skills)

• We offer free trials ranging from 3 to 30 days based on ongoing promotions
• No credit card, UPI mandate, or auto-debit authorization is required for free trials
• Trial users get access to selected flagship features as determined by Fixomotive
• Trial access automatically ends without any charges if not converted to a paid subscription
• Fixomotive reserves the right to modify or discontinue free trials at any time without notice
• Once a trial period ends, you may convert to a paid subscription by making manual payment

The free trial period is provided so users can fully evaluate the product’s suitability for their needs before making any payment.

8. Free Plan Terms (Fixomotive Store)

Fixomotive Store offers a free plan in addition to its paid plans. By using the free plan you acknowledge and agree that:

• The free plan provides limited features, storage, and capabilities, as determined by Fixomotive from time to time
• A free plan Published Site may be made available on a Fixomotive Store subdomain rather than a custom domain
• Features, limits, and availability of the free plan may be changed, restricted, or discontinued at any time, with or without notice
• Fixomotive may suspend, archive, or remove a free plan account and its associated Published Site if it remains inactive for an extended period, or for any breach of these Terms
• The free plan is provided on an “as is” basis without any service-level commitment

9. Subscription, Plans, Add-ons and Payment

• Paid subscriptions and add-ons become active only after successful payment
• For Fixomotive Repair and Fixomotive Skills, there is no auto-renewal — you must manually renew at the end of each subscription period
• Fixomotive Store paid plans and add-ons may be offered on monthly or yearly billing cycles as displayed at the time of purchase. Where a recurring or auto-renewing plan is offered, the renewal terms (including how to cancel renewal) will be clearly displayed before you subscribe, and you may cancel renewal at any time before the next billing date
• Current indicative pricing for Fixomotive Repair and Fixomotive Skills is ₹5,900 per year per product, and ₹9,999 per year for the Complete Bundle. Fixomotive Store plan and add-on pricing is displayed on the Fixomotive Store website and at the point of purchase
• Domain registration and renewal fees are separate from plan fees and are governed by Section 11
• All prices displayed are inclusive of applicable taxes unless stated otherwise
• Pricing, features, and plan structures may change with prior notice; for recurring plans, price changes apply from the next billing cycle

Accepted payment methods include Razorpay (cards, UPI, net banking, wallets), UPI, and bank transfer. Invoices will be issued for all paid subscriptions and add-ons. You agree to pay all applicable fees displayed at the time of purchase, including any taxes.

10. Fixomotive Store — Website Building, Hosting & Acceptable Use

10.1 Your Published Site

Fixomotive Store provides the tools and hosting to build and publish a website. As a Site Owner, you are solely responsible for all User Content and for everything that appears on, and every transaction conducted through, your Published Site. This includes the accuracy of your business information, prices, offers, product and service descriptions, and any claims you make.

10.2 Acceptable Use

You must not create, upload, publish, or transmit through Fixomotive Store any content or material that:

• Is unlawful, fraudulent, misleading, defamatory, obscene, or infringing of any third party’s intellectual property, privacy, or other rights
• Promotes or facilitates illegal goods, services, or activities
• Contains malware, viruses, or malicious code, or is used for phishing, spam, or unauthorized data collection
• Violates the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Consumer Protection Act, 2019, or any other applicable law

A detailed list of prohibited content and conduct is set out in our Acceptable Use Policy, which forms part of these Terms.

10.3 Intermediary Status and Takedown

In relation to User Content published by Site Owners, Fixomotive acts as an intermediary under the Information Technology Act, 2000. Fixomotive does not pre-screen User Content. Fixomotive reserves the right, without liability, to remove, disable, suspend, or take down any User Content or Published Site that it reasonably believes violates these Terms, the Acceptable Use Policy, or applicable law, or upon receipt of a valid legal or governmental request.

11. Fixomotive Store — Domain Registration & Custom Domain Mapping

11.1 Domains Purchased Through Fixomotive Store

Domain names purchased through Fixomotive Store are registered through our authorized third-party domain registration partner. Such registrations are also subject to the policies of that registrar, the relevant registry, and ICANN. You acknowledge and agree that:

• Domain registration and renewal fees are non-refundable once the domain has been registered or renewed, as the cost is incurred immediately with the registrar/registry
• You are responsible for renewing your domain on time; failure to renew may result in suspension, expiry, or loss of the domain
• You are responsible for providing accurate registrant information as required by applicable domain registration rules
• Domain availability, transfer, and any disputes (including under the relevant dispute-resolution policy) are governed by the registrar, registry, and ICANN rules, over which Fixomotive has no control

Detailed terms applicable to domains purchased through Fixomotive Store are set out in our Domain Registration Agreement, which forms part of these Terms.

11.2 Mapping a Domain You Already Own

If you map a custom domain that you have registered elsewhere, you remain solely responsible for that domain, including its registration, renewal, fees, and DNS configuration with your own registrar. Fixomotive is not responsible for any downtime, errors, or loss arising from incorrect DNS settings or the expiry of a domain held with a third-party registrar.

12. Fixomotive Store — Online Booking, Payments & E-commerce

12.1 Bookings and Enquiries

Fixomotive Store enables a Site Owner to receive appointment bookings and enquiries from End Visitors through the Published Site. A booking or enquiry made through a Published Site is a request made directly to the Site Owner. Fixomotive is not a party to, and gives no assurance regarding, any appointment, booking, or service arrangement between a Site Owner and an End Visitor.

12.2 Payments by End Visitors

Where a Site Owner enables online payments (for bookings or for products and services sold through its store), such payments are processed through the Site Owner’s own payment gateway / payment account, or through a third-party payment provider integration selected by the Site Owner. Fixomotive does not hold, control, collect, or process funds paid by End Visitors, and is not a payment aggregator, payment intermediary, or merchant of record for such transactions. All funds flow directly between the End Visitor and the Site Owner’s payment provider.

12.3 Site Owner as Merchant of Record

For all goods and services offered through a Published Site, the Site Owner is the seller and merchant of record. The Site Owner is solely responsible for:

• Fulfilment of all orders, bookings, products, and services
• Pricing, taxes (including GST), invoicing, and statutory compliance
• Its own refund, cancellation, shipping, and delivery policies towards its End Visitors
• Resolving any disputes, complaints, or chargebacks raised by End Visitors
• Compliance with the Consumer Protection Act, 2019, e-commerce rules, and all other applicable laws

Fixomotive’s Refund and Cancellation Policy applies only to the fees you pay Fixomotive for the Platform — it does not apply to transactions between a Site Owner and its End Visitors.

13. Fixomotive Store — Site Owner Responsibilities & Marketing Tools

As a Site Owner, you additionally agree that:

• You will maintain your own privacy notice and obtain any consents required from End Visitors for the data you collect through your Published Site
• When using Fixomotive Store marketing and communication tools, you will comply with all applicable laws, including the Digital Personal Data Protection Act, 2023, and TRAI regulations on commercial communications (including consent and do-not-disturb requirements); you will only contact persons who have consented to receive communications from you
• You are responsible for the legality, accuracy, and appropriateness of all marketing content you send using Fixomotive Store tools
• You will not use Fixomotive Store to send spam or unsolicited bulk communications

14. Refund and Cancellation Policy

All payments made to Fixomotive are generally final and non-refundable. The following limited exceptions apply, and this Section is supplemented by our separate Refund and Cancellation Policy:

14.1 Duplicate Payment

If you accidentally make duplicate payments for the same subscription or add-on, the duplicate amount will be refunded to your original payment method within 7 to 14 working days, after verification by our team.

14.2 Service Unavailability

If our services remain completely unavailable for more than 7 consecutive days due to issues attributable to Fixomotive (excluding force majeure events, scheduled maintenance, or third-party failures), you may claim a refund by emailing contact@fixomotive.in with your account and subscription details. Upon approval, a pro-rata refund will be processed for the unused subscription period, your account will be closed, and access will be revoked.

14.3 Domains and Add-ons

Domain registration and renewal fees are non-refundable in all circumstances (see Section 11). Add-ons that have been activated or consumed are non-refundable.

14.4 No Other Refunds

Apart from the exceptions above, no refunds will be provided under any circumstances, including change of mind, dissatisfaction with features, lack of usage, business closure or changes, personal or financial circumstances, compatibility issues not tested during the free trial or free plan, or voluntary account closure. By making payment after evaluating the free trial or free plan, you explicitly acknowledge and accept this policy.

15. User Conduct

You agree NOT to:

• Use the Platform for any illegal, fraudulent, or harmful activities
• Violate any intellectual property rights of Fixomotive, its sponsors, supporters, Content Partners, or third parties
• Upload harmful material, viruses, malware, or malicious scripts
• Share, transfer, or sell your account credentials
• Attempt to breach the security or integrity of the Platform
• Use the Platform to harass, defame, or harm any individual or entity
• Misrepresent your identity or affiliation
• Interfere with the Platform’s normal operation
• Collect or harvest data from the Platform without authorization

We reserve the right to suspend or terminate accounts that violate these rules without prior notice and without refund.

16. Intellectual Property Rights

16.1 Fixomotive’s Intellectual Property

All content created and owned by Fixomotive on the Platform — including wiring diagrams and circuit illustrations, technical manuals and procedures, ECM/ECU pinout data, AI-generated outputs and Fixi AI responses, website templates and design elements, graphics, logos, trademarks, and brand elements, videos and multimedia content, software code, architecture, database structure, user interfaces, and documentation — is the exclusive property of Fixomotive Solutions Private Limited or its licensors and is protected by Indian and international copyright, trademark, patent, and intellectual property laws.

16.2 Site Owner’s User Content (Fixomotive Store)

You retain ownership of the User Content you upload to Fixomotive Store. By uploading or publishing User Content, you grant Fixomotive a non-exclusive, royalty-free, worldwide license to host, store, reproduce, and display that User Content solely for the purpose of operating, providing, and improving the Platform and your Published Site. You represent and warrant that you own or have all necessary rights to your User Content and that it does not infringe any third-party rights or violate any law.

16.3 Sponsor and Supporter Content (Fixomotive Skills)

Fixomotive Skills may feature educational content, training modules, simulations, videos, and manuals contributed by third-party sponsors, supporters, partners, training institutes, OEMs, and content contributors (collectively, “Content Partners”). Such content remains the exclusive intellectual property of the respective Content Partner and is displayed under licensing or partnership arrangements. You may not download, copy, redistribute, modify, or commercially use any Content Partner material without the respective Content Partner’s written permission. Fixomotive acts only as a hosting and distribution platform for such content, and is not liable for errors, omissions, or claims arising from it.

16.4 General Restrictions

No content on the Platform — whether owned by Fixomotive, contributed by Content Partners, or uploaded by other Site Owners — may be copied, modified, distributed, sold, or publicly displayed without prior written consent from the respective rights holder. Any unauthorized use may result in legal action including injunctive relief, monetary damages, and criminal prosecution.

17. AI Output Disclaimer

The Platform incorporates Artificial Intelligence (AI) models, including the proprietary “Fixi AI” assistant, to generate diagnostic suggestions, repair guidance, and (where offered) content-assistance features. You acknowledge and agree that AI-generated outputs may contain errors, inaccuracies, or outdated information; are not OEM-verified or warrantied; are provided for reference only; cannot replace professional judgement, training, or proper procedures; and must be independently verified before you act on them. Fixomotive disclaims all liability for any damages arising from reliance on AI-generated content. AI features are also subject to our AI Output Policy.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Fixomotive shall not be liable for any damages of any kind arising from or related to your use of the Platform, including but not limited to direct, indirect, incidental, special, consequential, punitive, or exemplary damages; vehicle damage or malfunction; personal injury, accidents, or fatalities resulting from repairs performed by users; loss of revenue, profits, business, or opportunity; loss of data or business interruption; reputational harm or customer complaints; misdiagnosis or incorrect repair by users; misinterpretation of Platform content or AI outputs; transactions between a Site Owner and its End Visitors; content published by a Site Owner; third-party service failures or integration issues; Platform downtime, errors, bugs, or interruptions; loss caused by force majeure; and errors or claims related to sponsor or Content Partner material.

In no event shall Fixomotive’s total cumulative liability to you exceed the amount you paid to Fixomotive in the three months preceding the event giving rise to the claim. You expressly acknowledge that you use the Platform at your own risk.

19. Indemnification

You agree to indemnify, defend, and hold harmless Fixomotive, its directors, officers, employees, agents, affiliates, and Content Partners from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising from or related to: your use or misuse of the Platform; your violation of these Terms; your violation of any third-party rights, including Content Partner intellectual property; repairs performed by you on customer vehicles; the content of your Published Site and your User Content; goods or services you sell or transactions you conduct through Fixomotive Store; any claims by your customers, End Visitors, or third parties relating to your services; and your breach of any representations or warranties.

20. Data Privacy and Protection

Your personal information is collected, processed, and stored in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023 (DPDPA) of India.

20.1 Data Storage

Customer data is stored on Indian servers, in compliance with applicable data localization requirements.

20.2 Data Sharing

Fixomotive does not sell your personal data. Your data may only be shared with you (the account holder), with authorized service providers (such as cloud hosting, SMS gateway, email service, domain registration, and payment providers) strictly for delivering the Platform’s services and under confidentiality obligations, and with government authorities only when legally required.

20.3 End Visitor Data (Fixomotive Store)

Where a Site Owner collects personal data of End Visitors through its Published Site (for example, booking or enquiry details), the Site Owner is the data fiduciary in respect of that data, and Fixomotive acts as a data processor that processes such data only on the Site Owner’s behalf and instructions, for the purpose of operating the Published Site. The Site Owner is responsible for obtaining all necessary consents from, and providing required notices to, its End Visitors.

20.4 Data Retention and Your Rights

Your account data is retained while your account remains active. You may request deletion of your personal information by emailing contact@fixomotive.in, and we will delete your personally identifiable information within a reasonable time, subject to legal retention requirements. We may retain anonymized, aggregated analytics that do not identify you. Under applicable law you have the right to access, correct, and request deletion of your data, withdraw consent, and lodge complaints with the Data Protection Board of India.

21. Third-Party Services

The Platform may integrate with third-party services including payment gateways (Razorpay and others), cloud hosting providers, domain registrars, SMS and email API services, CRM platforms, and analytics providers. Use of these services is governed by their respective terms and privacy policies. Fixomotive is not responsible for any failures, errors, breaches, or damages caused by third-party services.

22. Account Termination and Offboarding

Fixomotive reserves the right to suspend or terminate your account without prior notice for violation of these Terms, fraudulent or abusive behavior, non-payment, sharing of credentials, reverse engineering or unauthorized data extraction, publishing prohibited content, or any other policy violation. Termination shall not entitle you to any refund except as specifically provided in Section 14.

Upon termination, expiry, or non-renewal of a Fixomotive Store paid plan, your Published Site may be unpublished, suspended, or deleted, and hosting may cease. You are responsible for exporting or backing up your User Content before your plan ends. A domain you purchased through Fixomotive Store remains subject to its own registration and renewal terms (Section 11). You may request voluntary account closure by emailing contact@fixomotive.in; voluntary closure does not entitle you to refunds for any unused period.

23. Software Updates and Changes

Fixomotive reserves the right to update, modify, or discontinue features at any time; modify plans and pricing with prior notice (for recurring plans, from the next billing cycle); improve, expand, or modify content, templates, and data; change AI models or algorithms; add or remove functionalities; and add, modify, or remove sponsor or Content Partner material. Continued use of the Platform after changes are implemented constitutes your acceptance of the updated Terms.

24. Force Majeure

Fixomotive shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, pandemics or epidemics, government actions or regulations, war, terrorism, civil unrest, internet, telecommunications or power failures, cyberattacks or security breaches, third-party service outages, and acts of God.

25. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

26. Entire Agreement

These Terms, together with our Privacy Policy, Refund and Cancellation Policy, Acceptable Use Policy, Domain Registration Agreement, AI Output Policy, and any product-specific terms, constitute the entire agreement between you and Fixomotive regarding the use of the Platform and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

27. Waiver

Failure by Fixomotive to enforce any provision of these Terms shall not be deemed a waiver of such provision or the right to enforce it later.

28. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. Fixomotive may assign these Terms to any successor or affiliate at any time without notice.

29. Channel Partners and Authorized Distributors

Fixomotive may make the Platform available through authorized Channel Partners, resellers, distributors, or white-label arrangements (collectively, “Channel Partners”). If you have obtained access to the Platform through a Channel Partner, the following additional terms apply.

29.1 Role of Channel Partners

A Channel Partner is an independent business entity that has entered into a formal agreement with Fixomotive to distribute, resell, or offer the Platform to end users. Channel Partners may process user payments through their own infrastructure, issue their own invoices, handle registration and onboarding, provide first-line support, manage refunds under their own policies, and offer the Platform under their own brand, co-branded, or as a Fixomotive-branded service.

29.2 Your Direct Commercial Relationship

If you subscribe through a Channel Partner, your direct commercial and contractual relationship for payment, invoicing, and support is with the Channel Partner, not Fixomotive. Payments are made to the Channel Partner; refund and cancellation requests are governed by the Channel Partner’s policy; and support is addressed by the Channel Partner in the first instance.

29.3 Data Sharing with Channel Partners

When you use the Platform through a Channel Partner, your personal information, account data, and usage information will be shared between Fixomotive and the Channel Partner on a joint basis, as necessary for service delivery, payment processing, support, billing, and legal compliance. Both parties act as joint data custodians and must handle your data in accordance with the Digital Personal Data Protection Act, 2023.

29.4 Fixomotive’s Role

In a Channel Partner arrangement, Fixomotive is primarily a technology and content provider: it provides and maintains the Platform’s software, infrastructure, and content, retains ownership of all Fixomotive intellectual property, receives shared access to user data for service delivery and compliance, is not directly responsible for payment processing, invoicing, or refunds made through Channel Partners, and may provide escalated support at its discretion.

29.5 Channel Partner Terms and Conflicts

Each Channel Partner may have its own Terms, Privacy Policy, Refund Policy, and support procedures, which apply in addition to these Terms. In any conflict on matters of payment, invoicing, refunds, or support, the Channel Partner’s terms prevail for those matters; for all other matters — including intellectual property, content accuracy, AI disclaimer, limitation of liability, and governing law — these Fixomotive Terms prevail.

29.6 Limitation of Liability for Channel Partner Actions

Fixomotive is not liable for payment failures or disputes involving Channel Partner systems, refunds denied or delayed by Channel Partners, Channel Partner support quality, Channel Partner data practices, or commercial representations made by Channel Partners. For such issues you must contact the relevant Channel Partner directly, though you may escalate unresolved matters involving the Platform’s core functionality, content, or intellectual property to contact@fixomotive.in.

29.7 Verification of Channel Partner Status

If you are uncertain whether your subscription is through a Channel Partner or directly from Fixomotive, you may contact contact@fixomotive.in for verification. Authorized Channel Partners are listed on the Fixomotive website and are bound by formal distribution agreements with Fixomotive.

30. Governing Law and Dispute Resolution

30.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

30.2 Arbitration

Any dispute, controversy, or claim arising out of or in connection with these Terms shall first be attempted to be resolved through good faith negotiations. If negotiations fail within 30 days, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by Fixomotive Solutions Private Limited. The seat and venue of arbitration shall be Balaghat, Madhya Pradesh, India; proceedings shall be conducted in English or Hindi; and the arbitral award shall be final and binding.

30.3 Jurisdiction

Subject to the arbitration clause above, the courts at Balaghat, Madhya Pradesh shall have exclusive jurisdiction over any matter arising out of or in connection with these Terms.
